Evaluate the current policies related to medicinal marijuana
As of February 2025, Kenya maintains stringent regulations regarding the use of cannabis, including its medicinal applications. The Narcotic Drugs and Psychotropic Substances (Control) Act criminalizes the possession and use of cannabis. However, there are specific exemptions within the law:
-
Medical Practitioners and Pharmacists: Licensed medical practitioners, dentists, veterinary surgeons, and registered pharmacists are permitted to possess and prescribe narcotic drugs, including cannabis, strictly for medical purposes.
-
Patients: Individuals with a valid prescription from a licensed medical professional are legally allowed to possess cannabis for medicinal use.
Despite these provisions, the National Authority for the Campaign Against Alcohol and Drug Abuse (NACADA) has consistently emphasized that cannabis remains an illegal substance in Kenya, cautioning against its use and highlighting potential health risks.
Globally, the legal landscape for medicinal cannabis is evolving. Countries like Australia have seen an increase in medicinal cannabis use since its legalization in 2016, aiding patients with conditions such as insomnia and anxiety.
Similarly, Ukraine legalized medical cannabis in August 2024, aiming to assist individuals, including war veterans, suffering from conditions like post-traumatic stress disorder (PTSD).
In contrast, many African nations, including Kenya, have been more cautious in adopting medicinal cannabis policies. While some countries have initiated reforms, the pace of change varies, and comprehensive policies are still under development.
In summary, while Kenyan law permits the use of medicinal cannabis under strict conditions, its application is limited, and enforcement agencies continue to regulate its use rigorously. The global trend shows a gradual shift towards embracing medicinal cannabis, but Kenya’s policies remain conservative, reflecting ongoing debates about its medical efficacy and potential societal impact.
